Wisconsin Supreme Court Halts John Doe Investigation Against Conservatives
Graves Garrett LLC is pleased to announce that the Wisconsin Supreme Court ruled today in favor of the firm’s clients, Wisconsin Club for Growth and Eric O’Keefe, in the state’s long-running “John Doe” investigation. The Club and O’Keefe were improperly forced to defend themselves against the wide-ranging investigation because of their support for Gov. Scott Walker’s policy agenda.
“The Supreme Court’s ruling today affirms the early decision of John Doe Judge Gregory Peterson, which essentially halted this investigation almost 18 months ago,” said Todd Graves, who with Edward Greim served as counsel. “But the Milwaukee County District Attorney John Chisholm and the Wisconsin Government Accountability Board (GAB) refused to give up on their novel theories about political coordination, and spent almost a year re-sifting the personal property they had seized and trying to re-define the crimes they originally claimed they were investigating.”
As Justice Gableman wrote in the opinion for the majority, “[i]t is utterly clear that the special prosecutor has employed theories of law that do not exist in order to investigate citizens who were wholly innocent of any wrongdoing. In other words, the special prosecutor was the instigator of a ‘perfect storm’ of wrongs that was visited upon the innocent Unnamed Movants and those who dared to associate with them.”
“The government acted as if key protections in our nation’s Bill of Rights simply did not apply,” Graves added. “They used search warrants to conduct pre-dawn raids on families and secretly obtained millions of personal emails from numerous parties, including individuals who still do not know they were targeted. They counted on a veil of secrecy to assault the fundamental liberties of our clients and commit taxpayer funds for an outrageous misuse of their offices and the law. They used their unlawful investigation to try to threaten and embarrass groups they do not like, specifically because of the groups’ constitutionally protected efforts on libertarian and conservative issues. Until today, District Attorney John Chisholm and the GAB acted like playground bullies without fear of restraint from the courts.”
As the Wisconsin Supreme Court stated, this “ends this unconstitutional John Doe investigation.” “We are pleased that the court agrees with the position we’ve maintained from the time our clients first learned of this improper political investigation,” Graves said.
