FCA settlement involving Graves Garrett client receives national, regional media coverage

Graves Garrett partners Nathan Garrett and Kathleen Fisher received widespread media coverage for their role in representing a client in a healthcare fraud whistleblower suit. The U.S. District Court for the Western District of Missouri approved a settlement in favor of the relator in the False Claims Act case involving Stark Pharmacy and its three owners.

The United States Attorney’s Office intervened in the case after finding that the firm’s client’s allegations that the pharmacy submitted materially false claims to the federal government had merit, leading to a nearly $10 million settlement being paid to the United States with a portion awarded to the whistleblower.

The story received coverage in Becker’s Hospital Review, The Kansas City Star, the Kansas City Business Journal and Missouri Lawyers Weekly. Additionally, the Associated Press distributed a version of the story to its national wire.

“These things are always long and always a grind,” Garrett told the KC Business Journal. “This one took about three years. But we’re really pleased that ultimately a settlement was able to be reached in what we believe is a fair outcome.”

Garrett and Fisher have represented relators and defendants in False Claims Act cases across the nation. This resolution marks the third whistleblower award Garrett and Fisher have achieved in the past in the past three years and adds to the firm’s national reputation in this arena.
